Terms and Conditions
	This agreement describes the entire terms and conditions for participation in the Certified Hosting Affiliate Program. Certified Hosting Solutions is owned and operated by Internet Ideas, Inc. In this agreement, Certified Hosting Solutions and Internet Ideas, Inc. are collectively referred to as Certified Hosting. In this agreement, the term "Affiliate" refers to you (the applicant). Wherever the agreement refers to "you" or "your", it means "the Affiliate"; "we" or "our" refers to Certified Hosting. CODED URL Upon your acceptance, Certified Hosting will provide you with a URL coded to specifically identify you which will allow you to create a link to the Certified Hosting web site. You may post this link in any location, as many times as you like subject to the remaining terms of this agreement regarding acceptable links. You agree to take full responsibility for ensuring the proper and continuing operation of your coded URL. You agree that you will notify Certified Hosting if your coded URL ceases to function or ceases to function properly. All referrals MUST come through your affiliate coded URL or no credit will be provided. COMMISIONS All affiliates are paid $65.00-$125.00 per new signup referred to Certified Hosting New sign-ups must stay a minimum of 90 days for affiliate commission to be paid Customers also cannot refer themselves or their spouse/civil union partner. No exceptions PAYMENT Affiliates are paid once a month for the prior months sales. All affiliates will be paid 45 days from the end of any given pay period EXAMPLE: Affiliates would be paid on May 15th for sign-ups generated during March 15th-March 31 EXAMPLE: Affiliates would be paid on May 30th for sign-ups generated during April 1st-April 15th Affiliates must generate affiliate commission of $50 or more before first check will be sent. Affiliates are paid by check ORDER FULFILLMENT Certified Hosting will be solely responsible for processing every order placed by a customer through the Affiliate Coded URL. Certified Hosting reserves the right to reject any order that does not comply with our rules, operating procedures and policies. CUSTOMERS Customers who purchase products and services through the Affiliate Program will be deemed to be customers of Certified Hosting. Accordingly, all Certified Hosting rules, policies, and operating procedures concerning customer orders and service will apply to those customers. We may change our policies and operating procedures at any time. Prices and availability of our products and services may vary from time to time. Certified Hosting policies will always determine the price paid by the customer. The customer referred to us originally, is now considered our customer. Any other orders placed from this customer will not be considered an affiliate related sale. No credit will be provided beyond the customers orginal order. ACCEPTABLE LINKS You may use the coded URL provided by Certified Hosting with promotional material provided or in any other form you wish, provided that your use of the URL is not in any way derogatory of Certified Hosting or otherwise not appropriate or acceptable in Certified Hosting's sole opinion and judgment. You may not violate any copyright, trademark or other intellectual property right of Certified Hosting or any other party. You may not violate the Certified Hosting General Terms of Service. You agree not to utilize any link that is or can be initiated automatically without the user clicking on the link. Certified Hosting reserves the right not to accept any site into the Affiliate Program based on site content. Sites that Do Not Qualify for the Certified Hosting Affiliate Program include sites which: promote violence promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age promote illegal activities violate intellectual property rights FREE HOSTING ACCOUNT Affiliate FREE hosting is a 1 domain only account with limited space and bandwidth to be used for the sole purpose of advertising Certified Hosting. Affiliate FREE hosting account are checked regularly. If you are found to be using the hosting for any other purpose the hosting account, along with your Affiliate account will be terminated. Current paid hosting accounts can not be converted to an Affiliate FREE hosting account. UNSOLICITED COMMERCIA EMAIL (SPAM) Certified Hosting in no way participates in mass unsolicited emailing (i.e. spamming), and all affiliates are expected to adhere to this policy as well. Violation of this policy will result in the termination of this contract and immediate dismissal from the Certified Hosting Affiliate Program, with no refund. RELATIONSHIP OF PARTIES You and we are independent contractors, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties. You will have no authority to make or accept any offers or representations on our behalf. You will not make any statement, whether on your site or otherwise, that reasonably would contradict this statement. LIMITATION OF LIABILITY We will not be liable for indirect, special, or consequential damages (or any loss of revenue, profits, or data) arising in connection with this Agreement or the Program, even if we have been advised of the possibility of such damages. Further, our aggregate liability arising with respect to this Agreement and the Program will not exceed the total commissions paid or payable to you under to this Agreement. DISCLAIMERS We make no express or implied warranties or representations with respect to the Affiliate Program or your potential to earn income from the Affiliate Program. In addition, we make no representation that the operation of our site or the Affiliate Sites will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions or errors. This Agreement will be governed by the laws of the United States and the District of Columbia, without reference to rules governing choice of laws. Any action relating to this Agreement must be brought in the federal or state courts located in Washington, DC, and you irrevocably consent to the jurisdiction of such courts. You may not assign this Agreement, by operation of law or otherwise, without our prior written consent. Subject to that restriction, this Agreement will be binding on, inure to the benefit of, and enforceable against the parties and their respective successors and assigns. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement. By submitting the Affiliate Order form, you acknowledge that you have read this agreement and agree to all its terms and conditions. You have independently evaluated this program and are not relying on any representation, guarantee or statement other than as set forth in this agreement.
